Hierbij lever je verschillende stukken aan, waaronder onderbouwing van de ontslaggrond, informatie over de organisatie en eventuele herplaatsingsinspanningen.<\/p><p>Voor een bedrijfseconomisch ontslag moet je aantonen dat het ontslag onvermijdelijk is, bijvoorbeeld door financi\u00eble gegevens en personeelsgegevens te overleggen. Die krijgt vervolgens de kans om schriftelijk verweer te voeren. Hiervoor geldt een termijn van 14 dagen. Er wordt gekeken naar de actualiteit van de omstandigheden, of de werkgever voldoende inspanningen heeft geleverd en of herplaatsing realistisch is. Bij bedrijfseconomisch ontslag beoordeelt het UWV of de personele ingreep gerechtvaardigd is. Dan mag het dienstverband worden opgezegd, met inachtneming van de geldende opzegtermijn. Je hoeft dan dus niet meer naar de rechter. Vergeet niet dat je bij be\u00ebindiging ook rekening moet houden met de <a href=\"https:\/\/www.arbeidsjurist-eindhoven.nl\/transitievergoeding\/\">transitievergoeding<\/a>.<\/p><p>Geeft het UWV geen toestemming? Dan zijn er twee opties. Je kunt ervoor kiezen om het dienstverband voort te zetten, of je kunt alsnog naar de kantonrechter stappen.
