De Algemene Verordening Persoonsgegevens (AVG) is dan direct van toepassing.<\/p><p>De wet vereist dat je alleen persoonsgegevens verwerkt als dat noodzakelijk is voor een duidelijk omschreven doel. Bovendien moet je werknemers daar helder over informeren. Wat vaak vergeten wordt, is dat geautomatiseerde besluitvorming, bijvoorbeeld bij promoties of ontslag, onder strikte voorwaarden valt. Er moet altijd ruimte zijn voor menselijke tussenkomst. Als werkgever ben je dus verplicht om controle te houden over wat het systeem doet en waarom. Doe je dat niet? Zo kunnen bepaalde groepen systematisch worden achtergesteld, bijvoorbeeld bij werving of beoordeling. Als werkgever ben je verantwoordelijk voor wat je AI-systeem doet. Je moet kunnen aantonen dat beslissingen eerlijk tot stand komen. Deze wet deelt AI-toepassingen in op basis van risico\u2019s. Systemen die worden ingezet voor werkgerelateerde beslissingen, zoals selectie- en beoordelingssoftware, vallen meestal onder \u2018hoog risico\u2019. Dat betekent dat er specifieke eisen gelden, bijvoorbeeld op het gebied van datakwaliteit, transparantie, monitoring en menselijke controle. Werkgevers moeten kunnen aantonen dat hun AI-systemen verantwoord zijn ingericht. Het vraagt dus om voorbereiding, duidelijke afspraken binnen de organisatie en blijvend toezicht op het gebruik van AI.<\/p><p>Wordt hier niet aan voldaan, dan zijn de gevolgen aanzienlijk. Toezichthouders kunnen hoge boetes opleggen, die kunnen oplopen tot tientallen miljoenen euro\u2019s of een percentage van de wereldwijde omzet. Daarnaast brengt het juridische risico\u2019s met zich mee, zoals schadeclaims van benadeelde werknemers. Ook reputatieschade of het moeten stilleggen van het systeem zijn re\u00eble scenario\u2019s.
