class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Een vaststellingsovereenkomst, ook wel <strong>be\u00ebindigingsovereenkomst genoemd<\/strong>, is een wettelijk toegestane manier om de arbeidsovereenkomst te be\u00ebindigen. In de vaststellingsovereenkomst zijn de voorwaarden opgenomen waaronder dat de arbeidsovereenkomst met \u201cwederzijds goedvinden\u201d wordt be\u00ebindigd.<strong>\u00a0<\/strong><\/p><p>Een aantal elementen zijn belangrijk om te kunnen spreken van een juridisch correcte vaststellingsovereenkomst. Ook wil je dat de\u00a0<strong>overeenkomst \u201c<a href=\"https:\/\/www.arbeidsjurist-eindhoven.nl\/kennisbank\/vaststellingsovereenkomst-ww-uitkering\/\">WW-proof<\/a>\u201d<\/strong>\u00a0is oftewel dat je in aanmerking kunt komen voor een uitkering van het UWV. Daarvoor worden veelal neutrale ontslaggronden opgenomen zoals: \u201cdat sprake is van bedrijfseconomische redenen (reorganisatie)\u201d of \u201cdat er een verschil van inzicht bestaat tussen partijen over de uitoefening van de functie en dat dit verschil van inzicht niet te overbruggen is\u201d. Vervolgens wordt opgenomen dat het initiatief van de vaststellingsovereenkomst bij de werkgever ligt en dat de werknemer zich hier in eerste instantie tegen heeft verzet. Het komt zelden voor dat de feitelijke situatie wordt beschreven omdat dit veelal tot vragen leidt en de werknemer het risico loopt dat het UWV stelt dat hij verwijtbaar werkeloos is waardoor een sociale uitkering wordt ontzegd.<\/p><\/div>\t\t\t\t\t\r\n\t\t\t\t\t\t<\/div> \r\n\t\t\t\t\t\t\t\t\t\t\r\n\t\t\t\t<\/div> \r\n\t\t\t\t\t\t\t\t<div class=\"theplus-accordion-item\"  role=\"tab\">\r\n\t\t\t\t\t<div id=\"elementor-tab-title-5622\" class=\"elementor-tab-title plus-accordion-header 0 text-left \" data-tab=\"2\" aria-controls=\"elementor-tab-content-5622\"\t\t\t\t\t>\r\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"accordion-icon-prefix \"><i class=\"plus-icon-accordion fa fa-check-circle\"><\/i><\/span> \r\n\t\t\t\t\t\t\t\t\t\r\n\t\t\t\t\t\t<span style=\"width:100%\">Einddatum<\/span>\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-right\" aria-hidden=\"true\"><span class=\"elementor-accordion-icon-closed\"><i aria-hidden=\"true\" class=\"fas fa-chevron-up\"><\/i><\/span><span class=\"elementor-accordion-icon-opened\"><i aria-hidden=\"true\" class=\"fas fa-chevron-down\"><\/i><\/span><\/span>\t\t\t\t\t<\/div>\r\n\r\n\t\t\t\t\t\t\t\t\t\t\t<div \r\n\t\t\t\t\t\tid=\"elementor-tab-content-5622\" class=\"elementor-tab-content elementor-clearfix plus-accordion-content 0 \" data-tab=\"2\" role=\"tabpanel\" aria-labelledby=\"elementor-tab-title-5622\"\t\t\t\t\t\t> \r\n\t\t\t\t\t\t\t\t\t\t<div class=\"plus-content-editor\" ><p>Bij de einddatum moeten partijen rekening houden met de wettelijke opzegtermijn of de langere termijn als die in de arbeidsovereenkomst of cao staat. Deze termijn moet zitten tussen de datum van ondertekening en de einddatum. Stel de arbeidsovereenkomst heeft korter geduurd dan 5 jaar en er is geen langere opzegtermijn overeengekomen dan is het volgende van toepassing.<\/p><p>Voorbeeld: wanneer je 27 september tekent, dan zal de maand oktober als opzegtermijn gelden en kan de laatste werkdag zijn 30 oktober. Per 1 november kun je dan in aanmerking komen voor een sociale uitkering. Daarvoor worden veelal neutrale ontslaggronden opgenomen zoals: \u201cdat sprake is van bedrijfseconomische redenen (reorganisatie)\u201d of \u201cdat er een verschil van inzicht bestaat tussen partijen over de uitoefening van de functie en dat dit verschil van inzicht niet te overbruggen is\u201d. Vervolgens wordt opgenomen dat het initiatief van de vaststellingsovereenkomst bij de werkgever ligt en dat de werknemer zich hier in eerste instantie tegen heeft verzet.
